Electric Scooters in Miami
Miami's warm weather and compact neighbourhoods make it a natural fit for electric scooters. Here is how Florida state law and local rules in Miami and Miami Beach apply to e-scooter riders in 2026.
Are e-scooters legal in Miami?
Yes. Florida law allows motorized scooters, defined as devices with no more than three wheels that cannot go faster than 20 mph on level ground. Under Florida Statutes section 316.2128, a scooter rider has the same rights and duties as a bicycle rider.
Florida state rules
- No driver's licence, registration or insurance is needed to ride a motorized scooter.
- Ride with traffic and follow the same rules of the road as cyclists.
- Florida's bicycle helmet law requires riders under 16 to wear a helmet. Helmets are recommended for every rider.
- At night, bicycle lighting rules apply: a white front light and a red rear light and reflector.
- Cities and counties can set their own rules for streets and sidewalks, including minimum ages and a requirement to carry photo ID.
City of Miami
In September 2026, the City of Miami began considering a citywide ordinance for e-scooters and e-bikes. As proposed, it would:
- Ban riding on public sidewalks and pedestrian walkways (walking or parking a scooter would still be allowed).
- Require riders to use bike lanes where available, or streets with a speed limit of 30 mph or less.
- Bar riders under 16 from city streets and require riders to carry government-issued photo ID.
- Require scooters to be parked in designated spots, leaving at least three feet of clear space for pedestrians.
- Set fines of up to $100.
The ordinance must pass the full city process before it takes effect, so check the City of Miami's current rules before riding.
Miami Beach
Miami Beach approved new rules for scooters and e-bikes in September 2026, taking effect on July 22, 2027. They require white and red lights from sunset to sunrise, working brakes, and helmets for riders under 16, with a $129 fine for violations. Always yield to pedestrians, especially on the Beachwalk and other shared paths.
The HAZEL 1.0 in Miami
Hazel Studios ships the HAZEL 1.0 folding electric scooter to the United States. Its 24 km/h (14.9 mph) top speed is within Florida's 20 mph limit for motorized scooters. For rules in other states, read our guide to e-scooter laws in the United States.
This page is a general summary, not legal advice. Rules can change, so always confirm current Florida law and your city's ordinances before riding.
